Ticketmaster x Disney+ - Full Terms and Conditions
1. Participants agree to be bound by these terms and conditions (the “Terms and Conditions”). Any information or instructions published by the Promoter about the Promotion at www.ticketmaster.com.au/disney form part of the Terms and Conditions.
2. The promoter is Ticketmaster Australasia Pty Ltd of 111 Cambridge Street, Collingwood Victoria, Australia (the “Promoter” or “Ticketmaster”).
3. The Ticketmaster Disney+ promotion (“Promotion”) will commence at 12:01am AEST on 1 October 2024 and distribution of Disney+ Codes (as defined below) will cease on 26 November 2024, unless withdrawn earlier or extended (the “Offer Period”).
4. To be eligible to qualify for a Disney+ Code, each participant must during the Offer Period:
(a) be an Australian resident with an Australian residential address;
(b) be a new or returning Disney+ subscriber (i.e. not existing Disney+ subscribers and persons who have an existing entitlement to a Disney+ subscription including “free trial” subscriptions that were cancelled before becoming fully paid subscriptions);
(c) be 18 years of age or older;
(d) have a My Ticketmaster account that you're logged into at the time of eligible purchases for the purposes of paragraph (f);
(e) not have previously received a Disney+ Code under this Promotion; and
(f) spend a minimum of AU$50 + GST on tickets for events on Ticketmaster.com.au or the Ticketmaster app during the Offer Period (not including any spend in relation to which the participant has received a refund, credit or exchange, other than for a reason outside of their control, such as a cancellation or reschedule) (“Spend Threshold”) (each an “Eligible Participant”).
5. Eligible Participants who spend the Spend Threshold while logged into their My Ticketmaster account on Ticketmaster.com.au or the Ticketmaster app during the Offer Period will be entitled to a four (4) month Disney+ Standard plan subscription gift with purchase currently valued at $55.96 (“Offer”). Eligible Participants can redeem the Offer by using the unique Disney+ activation code sent via email (“Disney+ Code”).
6. To redeem the Offer, activate your Disney+ Code by 11:59pm AEST on the date which is thirty (30) days from the date the code is issued to you by email. Otherwise, the Disney+ Code may expire and the Offer may be forfeited.
7. Disney+ Codes are for use in Australia only.
8. Regardless of whether an Eligible Participant reaches or exceeds the Spend Threshold multiple times during the Offer Period, each Eligible Participant will only be eligible to redeem one (1) Offer. Each Disney+ Code may be used only once.
9. Eligible Participants may receive their Disney+ Code by either:
(a) If the Eligible Participant is opted in to receive Partner Offers from Ticketmaster and its Partners: please allow up to 5 days and your Disney+ Code will be emailed to the email address associated with your My Ticketmaster account.
(b) If the Eligible Participant is not opted in to receive Partner Offers from Ticketmaster and its Partners: you will not automatically receive an email with a Disney+ Code in accordance with your marketing preferences. You may claim your code by checking your eligibility at www.ticketmaster.com.au/disney and, if you are an Eligible Participant, you will be emailed your Disney+ Code. Please allow up to 1 day to receive your Disney+ Code. Please note that by entering your email address to check your eligibility, you will not be opting in to receive Partner Offers generally but you will be consenting to receive emails about the Promotion, including the Disney+ Code and reminders to redeem the Offer. Any Disney+ marketing preferences will be managed by you in your Disney+ account.
If you do not satisfy either of the options to receive a Disney+ Code above during the Offer Period, you will not receive a Disney+ Code.
10. A condition of redemption of the Offer using a Disney+ Code is that the Eligible Participant must create a new Disney+ account with a valid e-mail address or log in to a previously used Disney+ account (that does not have a current active subscription) and accept the Disney+ Subscriber Agreement, Privacy Policy, Collection Statement and other legal documents available at: www.disneyplus.com/legal as well as these Terms and Conditions.
11. On expiry of an Eligible Participant subscriber's 4-month Offer subscription to Disney+ (“Promotional Period”), their Disney+ Standard subscription will automatically renew and the payment method provided will be automatically charged at the then-current monthly rate for the Disney+ Standard tier (currently $13.99/month) on a monthly basis until cancelled. An Eligible Participant subscriber may cancel their subscription at any time before the end of the Promotional Period, and they will not be charged. If an Eligible Participant subscriber cancels their Disney+ subscription after the end of the Promotional Period, the cancellation will be effective at the end of the relevant billing period.
12. Unless required by law, Disney+ Codes and the Offer are not refundable or redeemable for cash or any other goods or services and cannot be sold or transferred, or exchanged or credited towards purchase of other subscriptions, and will not be honoured if obtained from any third party.
13. The Offer is strictly limited to one redemption per person and cannot be combined with any other offers, coupons, discounts or promotions.
14. Subscription to Disney+ requires a compatible device and internet connection. Data charges may apply.
15. A credit card, debit card or PayPal account will be required to redeem the Offer using a Disney+ Code.
16. Disney+ Code claims and redemptions that are incomplete or damaged will be deemed invalid. No responsibility is accepted by the Promoter for lost, delayed or damaged data which occurs during any communication or transmission of claims or redemptions.
17. Unless required by law, the Promoter reserves the right at its absolute discretion to disqualify claims which it reasonably considers do not comply with these terms and conditions.
18. Unless required by law, the Promoter shall have the right, where reasonably necessary, to undertake all such action as is reasonable to protect itself against fraudulent or invalid claims of a Disney+ Code or the Offer including, without limitation, to require further verification as to proof of purchase, as well as the identity, age, and other relevant details of an otherwise Eligible Participant.
19. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the Promoter's reasonable control, including but not limited to technical difficulties, unauthorised intervention or fraud, and the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to disqualify any participant, modify, suspend, terminate or cancel the Promotion, as appropriate.
20. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth) and applicable fair trading laws (“Non-Excludable Guarantees”).
21. Except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, the Promoter and The Walt Disney Company (Australia) Pty Ltd (“Disney”) (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any as a result of or in relation to this Promotion , including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's or Disney's control); (b) any theft, unauthorised access or third party interference; (c) any Disney+ Code or Offer that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter or Disney; (d) any tax liability incurred by you; or (e) use of the Offer.
22. Neither the Promoter or Disney nor any related entity of the Promoter or Disney will be responsible for any problems or technical malfunction of any computer online systems, servers or providers, computer equipment, software, failure of any order to be received by the Promoter on account of technical problems or traffic congestion on the internet.
23. Any costs associated with accessing the Promoter's website is the entrant's responsibility and is dependent on the internet service provider used.
24. Any provision of these Terms and Conditions which is invalid or unenforceable in any jurisdiction is to be read down for the purpose of that jurisdiction, if possible, as to be valid and enforceable, and otherwise must be severed to the extent of the invalidity or unenforceability, without affecting the remaining provisions of these Terms and Conditions or affecting the validity or enforceability of that provision in any other jurisdiction
25. This Promotion is governed by the laws of Victoria, Australia and the parties submit to the non-exclusive jurisdiction of the courts of Victoria.
